A Florida Law Firm Devoted to Seeking Justice After An Inmate Death

The Law Firm of Lauer & Currie, P.A. will only take jail wrongful death cases where the conduct is so egregious that it crosses the line from negligence to deliberate indifference to a serious medical need.

When the defendants’ deliberate indifference causes a death, we file the case in Federal Court as a Civil Rights Violations under 42 U.S.C. § 1983. We regularly add medical malpractice claims as part of these cases but the lawsuits remain in Federal Court. Because we have fifteen years of experience suing jails and the private medical companies that provide inmate health care in the jails, we have learned that Federal Court is the best place to bring these cases. In Federal Court, unlike State Court, we are automatically entitled to recover punitive damages if we are successful on our Federal claims. In addition, we are often able to force the defendants to pay our attorney’s fees and costs. In wrongful death cases filed in Florida State Court, the Plaintiff is not able to collect more than $300,000 in damages. In Federal Court, these caps on damages do not exist.

After years of hard work, the attorneys at Lauer & Currie, P.A. have become experts in inmate wrongful death cases. Over the past 15 years, the law firm of Lauer & Currie, P.A. has obtained a variety of multi-million dollar jury verdicts, judgments and settlements for our clients in Federal Civil Rights cases.
