When the defendants’ deliberate indifference causes a death, we file the case in Federal Court as a Civil Rights Violations under 42 U.S.C. § 1983. We regularly add medical malpractice claims as part of these cases but the lawsuits remain in Federal Court. Because we have fifteen years of experience suing jails and the private medical companies that provide inmate health care in the jails, we have learned that Federal Court is the best place to bring these cases. In Federal Court, unlike State Court, we are automatically entitled to recover punitive damages if we are successful on our Federal claims. In addition, we are often able to force the defendants to pay our attorney’s fees and costs. In wrongful death cases filed in Florida State Court, the Plaintiff is not able to collect more than $300,000 in damages. In Federal Court, these caps on damages do not exist.
